Tenant Turner SentriLock (Generation 3) Limited Hardware Warranty

General

BY PURCHASING A SENTRILOCK LOCKBOX FROM TENANT TURNER, YOU AGREE TO THE TERMS OF THIS LIMITED HARDWARE WARRANTY. IF YOU DO NOT AGREE TO THE LIMITED HARDWARE WARRANTY TERMS, DO NOT PURCHASE THE SENTRILOCK LOCKBOX.

"Customer" shall mean the Customer with an active, paid Plan as defined in the Tenant Turner Customer Terms of Use who purchases one or many Lockboxes from Tenant Turner.

"Lockbox" shall mean SentriLock Bluetooth® REALTOR® Lockbox.

"Hardware" shall mean Lockbox sold or licensed to Customer by Tenant Turner.

"Ineligible Hardware" shall mean Lockbox sold or licensed to Customer by Tenant Turner.

Terms

Tenant Turner warrants that the Hardware: (i) will be free from defects and deficiencies in workmanship and materials; (ii) will be of merchantable quality; and (iii) will function in good operating order in accordance with SentriLock's published specifications. The Limited Hardware Warranty only applies to Hardware purchased directly from Tenant Turner. The Limited Hardware Warranty set forth in this document is the complete warranty and may not be modified, extended or superseded, either orally or in written form by any employee of Tenant Turner nor of SentriLock.

Duration

The Warranty Period for Hardware purchased directly from Tenant Turner shall start upon delivery of Hardware to Customer and shall be six (6) years for lockbox. All Warranties terminate with termination of the Plan as defined in the Tenant Turner Customer Terms of Use.

Exclusions

The Limited Hardware Warranty does not extend to, and Tenant Turner specifically disclaims any warranty claim arising out of: (i) any Hardware not directly purchased from Tenant Turner; (ii) any misuse or abuse of the Hardware, including the misplacement of keys or other access tools within the lockbox vault; (iii) cosmetic defect or cosmetic damage; (iv) any attempt to open, alter, dismantle or repair the Hardware other than battery replacement or other SentriLock published maintenance procedures, including cutting of the lockbox shackle; (v) any alteration, modification, or attachment to the Hardware not specifically designed or approved by Tenant Turner; (vi) exposure to or operation in temperatures outside those defined in the Specifications; (vii) water damage; (viii) acts of vandalism or theft; (ix) acts of nature; (x) use of a non-SentriLock approved replacement battery; or (xi) failure to follow SentriLock's operating and maintenance procedures, as established from time to time and published on SentriLock's website.

Warranty Claims

The sole remedy available to Customer for a Warranty Claim is replacement of defective Hardware. Prior to making a Warranty Claim, Customer must submit a SentriLock Troubleshooting form (see "SentriLock Lockbox Troubleshooting Form") for each defective Hardware item. If the troubleshooting steps of SentriLock Troubleshooting form do not resolve the issue, Customer may initiate a Warranty Claim by completing the "Request additional SentriLock support" section of the SentriLock Troubleshooting form. Warranty Claims must follow these steps:

  1. Tenant Turner support will review the SentriLock support request and contact Customer for clarification as needed.
  2. Tenant Turner support will, at its sole discretion, file a SentriLock Replacement Request.
  3. Tenant Turner will ship Customer an equivalent Lockbox of merchantable quality and charge Customer a replacement deposit equal to the then-current retail price. Tenant Turner will pay standard ground shipping to send Customer the replacement Hardware and include a prepaid return shipping label for Customer to return the defective Hardware.
  4. Upon receiving the defective Hardware by return shipping, Tenant Turner will complete the Warranty Claim by fully refunding the replacement deposit.

At Tenant Turner's sole discretion, a Warranty Claim may be denied if the Lockbox is utilizing batteries not supplied directly by Tenant Turner. For each item of Hardware (i) returned to Tenant Turner without a previously supplied legitimate Tenant Turner-issued SentriLock Replacement Request, or (ii) found to be, in Tenant Turner's reasonable judgment, either (a) in a condition grossly misrepresented by Customer when obtaining the SentriLock Replacement Request from Tenant Turner or (b) excluded from Warranty coverage as provided above, such item shall be deemed to be excluded from Warranty coverage and Tenant Turner shall notify Customer of the ineligibility. In the event of an ineligible Warranty Claim, Customer may request Tenant Turner (a) return the Ineligible Hardware to Customer, the shipping cost for which shall be charged to Customer, or (b) discard the Ineligible Hardware. If Customer fails to notify Tenant Turner of its decision within fifteen (15) days or if Customer chooses to discard Ineligible Hardware, Tenant Turner shall have no further responsibility to Customer for repair, replacement, or return of Ineligible Hardware. If Tenant Turner finds that an item of Hardware is excluded from Warranty coverage, Tenant Turner shall have no further responsibility to Customer for repair, replacement, or return of Ineligible Hardware.

THE WARRANTY SET FORTH HEREIN IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES WHETHER STATUTORY, EXPRESS OR IMPLIED. ALL OTHER WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, ARE EXCLUDED.
